Yacht Butler Boat Care Ltd. Monthly Subscription Service Agreement
1. Introduction This Monthly Subscription Service Agreement (“Agreement”) is entered into by and between Yacht Butler Boat Care Ltd. (“Yacht Butler” or “Company”) and the subscriber (“Customer”). This Agreement outlines the terms and conditions under which Yacht Butler will provide monthly boat check services to the Customer.
2. Services Provided Yacht Butler offers two main subscription services:
- Exterior Service, providing a visual inspection of the yacht’s exterior and surroundings.
- Interior Service, including all services in the Exterior Monthly Service plus an interior check of the yacht.
Additional a-la-carte services are available as described on Yacht Butler’s website or through offer emails.
3. Subscription Fees and Payment Terms Fees for the subscription services are as outlined above. Payment will be processed according to the information provided in the web store upon signing up. All payments are due in accordance with the selected subscription plan (monthly or annual).
4. Term and Renewal This Agreement commences upon the Customer’s subscription and is fixed for the term selected (monthly or annual). Subscriptions automatically renew under the same terms unless the Customer cancels in accordance with the cancellation policy.
5. Cancellation Policy Customers may cancel within 24 hours of subscription for a full refund, minus processing fees. Monthly subscriptions may be cancelled at any time with no refund after the 24-hour grace period, and service will conclude after the next scheduled visit. Annual subscriptions cancelled after the 24-hour grace period will receive a pro-rated refund based on the regular monthly rate, minus processing fees.
6. Liability and Insurance Yacht Butler maintains $2 million in comprehensive liability insurance. The Company is not liable for issues not observed during checks which would not be obvious and concerning to a reasonable person under the same circumstances.
7. Service Scheduling Monthly checks are scheduled by Yacht Butler’s operations department. While there are no blackout dates or times, Yacht Butler cannot guarantee service on a specific date within the month.
8. Privacy Policy Yacht Butler complies with all Canadian privacy laws and adheres to industry best practices in data management and sharing.
9. General Terms
- This Agreement constitutes the entire agreement between Yacht Butler and the Customer.
- Any amendment to this Agreement must be in writing and signed by both parties.
- This Agreement is governed by the laws of Canada.
10. Acceptance By subscribing to Yacht Butler’s monthly subscription service, the Customer agrees to the terms and conditions outlined in this Agreement.
